Protecting the privacy of your personal information is very important to Simple Giving, Inc. ("Simple Giving", "we" or "us") and we understand that you are concerned about how your personal information is collected, used, and shared. This privacy policy (this "Privacy Policy") is intended to advise you ("User" or "you") of the policies and practices we use regarding the collection, usage, maintenance, protection, and disclosure of your information on our website (the "Website") and any other platform, application, software or programs offered by Simple Giving (collectively, the "Product"). This privacy policy governs only the personal information collected via our Website and Product and how it is used and disclosed and does not govern the collection of information through other means (for example, via telephone or through the mail).

By registering on the Website and/or Product, you will receive emails, push notifications and other communications from Simple Giving and/or its Affiliates. As a Simple Giving participant, it will be necessary for us to communicate with you to provide essential operational, administrative, service, status and transaction updates as well as notices in connection with your account and other information relevant to your participation and use of the Website and/or Product (collectively, "Core Communications"). You may not opt out of such Core Communications, and you agree to your receipt of Core Communications via email, push notifications and/or other communication methods provided by you in your account registration.

By using the Product, you understand and agree that we may communicate with you in order to provide information relevant to your participation and use of the Product through the use of push notifications and other means of providing notices to you in connection with your account.

3. Choice/Opt-Out

You may choose to withdraw your consent regarding further contact or further collection, use, or disclosure of your information, at any time, by contacting us at This ability to withdraw consent from communication shall not apply to Core Communications, as stated above. All Core Communications will be governed by Section 2 of this Privacy Policy.

If you choose to withdraw consent, we will then use reasonable efforts to remove your personal information from our files, unless we are entitled to retain it pursuant to an agreement that you have entered into with us.

4. Personal Information Collected About You

We may collect and store personal information about you that you voluntarily supply to us when you use the Website and/or Product. The collection of personal information allows us to contact you and provide our services to you. Personal information includes any information that identifies you personally, which includes, but is not limited to information such as your name, phone number, birth date, and email address. Specifically, you must register and provide this information with the Website and Product in order to have access to the Simple Giving services.

Personal information is collected whenever you voluntarily provide it through the Website or Product, such as if you create a Simple Giving account. It is completely optional for you to use the Website or Product and provide us with this type of personal information. Accordingly, you may choose to not provide this information to us and discontinue the use of the Website or Product at any time.

5. Use of Personal Information by Simple Giving

We use your personal information to provide you with services, to send you messages, and for other purposes described in this Privacy Policy or disclosed to you on the Website and/or Product. Examples of personal information usage include, but are not limited to: creating and managing your account; processing your transactions; displaying content that is customized to your account; responding to comments and questions and providing customer service; delivering service messages and other services and content you request and sending information related to accounts and services; sending you information about new promotions, products, and services offered by us and our selected partners; researching our user‘s interests, demographics, and behaviors based upon the information provided in order to better understand and serve our users; and conducting an aggregated analysis of the performance of promotions.

6. Sharing of Personal Information

Personal information about users is an important part of our business and we are not in the business of selling it to others. Your information is not shared or sold to third parties for commercial purposes, except as previously outlined in Section 5, with your consent, or under the following circumstances: (1) it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, to enforce or apply the Terms of Service and other agreements, to protect the rights, property, or safety of Simple Giving, our users, or others, or as otherwise required by law; or (2) in the event of merger, sale of company assets, financing, or acquisition of all or a portion of the Simple Giving business to another company. The security of your personal data is important to us. We take reasonable security measures consistent with current industry standards to protect your personal information to prevent loss, misuse, unauthorized access, disclosure, alteration, and destruction. All information gathered on the Website and/or Product is stored within password controlled databases to which only we have the password. Your personal information data is stored only as long as is necessary to use the Simple Giving services.

Users shall take reasonable steps to maintain the security of communications while using the Simple Giving Website and/or Product, including but not limited to reasonable steps: to authenticate users using individual passwords, to maintain confidentiality of passwords, to maintain physical security of equipment and facilities in their respective control, to exercise appropriate oversight and supervision of their respective personnel, to evaluate their respective security safeguards periodically, to install and maintain appropriate firewalls and other technical measures where appropriate, and to guard against the intentional or unintentional corruption or loss of data in their respective control. From time to time we may supplement information you give us with information from other sources, such as information validating your address. Thus, information we obtain through the Website and/or Product may be intermingled with and used in conjunction with information obtained through sources other than the Website or Product, including both online and offline sources.

12. Automatic Information Collected About You

In addition to the collection of personal information, we may also collect or log non-personal information about you and your use of the Website and/or Product. For example it is standard for your web browser to automatically send information to every website you visit, including the Website. This information includes your Internet Protocol ("IP") address, access times, browser type and language, referring website addresses and your domain name. An IP address is a number that is automatically assigned to your computer by the Internet Service Provider ("ISP") computer through which you access the Internet, and a domain name is the name of the ISP computer itself through which you access the Internet. 15. Use of the Website and Product by Minors is Prohibited

The Website and Product is not directed to children under the age of 18. We do not knowingly collect personally identifiable information from children under 18 years of age. If we discover that a child under the age of 18 has provided the Website or Product with personally identifiable information, we will immediately and completely delete that child‘s personally identifiable information from our servers.

By using this Website or the Product, you represent that you are at least the age of majority in your state or province of residence and you have given us your consent to allow any of your dependents to use this Website and/or Product.

16. International Users

If you are visiting the Website or Product from a location outside the United States, your connection will be through and to servers located in the United States, your transactions will be fully processed in the United States, and all information you provide will be processed and securely maintained in our Website servers and internal systems located within the United States.

18. Your California Privacy Rights

California Civil Code Section § 1798.83 permits users of the Simple Giving Website and Product that are California residents to request and obtain from us a list of what identifiable information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year and the names and addresses of those third parties. Requests may be made only once a year and are free of charge. We currently do not share any identifiable information with third parties for their direct marketing purposes.

19. Relationship to Terms and Conditions of Use and Other Contracts

This Privacy Policy must be read in conjunction with our Terms of Service, and the provisions of our Terms of Service are incorporated herein. To the extent the Terms of Service conflict with the terms of this Privacy Policy, the terms of this Privacy Policy will control. This Privacy Policy should also be read in connection with any separate agreements between you and Simple Giving.
